Terms of Service

By accessing or using Flexbuild ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms apply to all visitors, users, and others who access or use Flexbuild.

We reserve the right to update or modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the platform. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

To use certain features of Flexbuild, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.

You are responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately at [email protected] if you suspect any unauthorized access.

You must be at least 13 years old (or the minimum age required in your jurisdiction) to create an account. By registering, you represent that you meet this age requirement.

We reserve the right to suspend or terminate accounts that violate these Terms, contain false information, or remain inactive for an extended period.

What Flexbuild Provides

Flexbuild is an AI-powered application builder that enables users to create web applications, mobile applications, and other software by interacting with AI through a chat interface. The Service includes code generation, live preview, project hosting, code editing, and deployment features.

Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify users of planned downtime.

AI-Generated Content

Code and content generated by the AI are provided "as is." While we strive for accuracy and quality, AI-generated output may contain errors, bugs, or security vulnerabilities. You are responsible for reviewing, testing, and validating all generated code before deploying it to production environments.

Credit System

Flexbuild operates on a credit-based usage model. Each AI interaction consumes one credit. Your plan determines your monthly credit allocation and any daily limits.

Free Plan

The Free plan provides 35 credits per month with a maximum of 5 credits per day. Free plan users are subject to additional feature limitations as described on the Pricing page.

Paid Plans

Paid subscriptions (Pro and Max) are billed monthly through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis. All prices are in US Dollars unless otherwise stated.

Refunds

Payments are non-refundable except where required by applicable law. If you cancel your subscription, you retain access to your paid plan features until the end of the current billing period. No partial refunds are issued for unused portions of a billing cycle.

Credit Rollover

Unused credits roll over month to month while your subscription remains active. If your subscription lapses or is cancelled, unused credits are forfeited and your account reverts to the Free plan allowance.

Price Changes

We reserve the right to change our pricing. Existing subscribers will receive at least 30 days' notice before any price change takes effect on their account.

Your Content

You retain ownership of the content you create using Flexbuild, including the code, designs, and other materials generated through your use of the Service. By using the Service, you grant us a limited license to store, process, and display your content as necessary to provide the Service.

Flexbuild Platform

The Flexbuild platform, including its design, branding, user interface, documentation, and underlying technology, is owned by Flexbuild and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the platform.

Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant us an unrestricted, perpetual, irrevocable license to use, modify, and incorporate such feedback without obligation to you.

You agree not to use Flexbuild to:

• Generate, store, or distribute malware, viruses, or any code intended to damage, disrupt, or gain unauthorized access to systems or data.

• Create applications that facilitate illegal activities, including but not limited to fraud, phishing, money laundering, or the distribution of illegal content.

• Harass, abuse, threaten, or impersonate other users or any person.

• Scrape, data-mine, or systematically extract data from the platform beyond normal use of the Service.

• Attempt to bypass credit limits, rate limits, or other usage controls through technical means.

• Use the Service to build competing products or to benchmark the Service for competitive purposes.

• Violate any applicable local, state, national, or international law or regulation.

We reserve the right to investigate violations and take appropriate action, including suspending or terminating your account without notice or refund.

Flexbuild integrates with third-party services including Stripe (payments), GitHub (code hosting), Supabase (infrastructure), and various AI providers (Google, Anthropic, OpenAI). Your use of these third-party services is governed by their respective terms and privacy policies.

We are not responsible for the availability, accuracy, or practices of third-party services. Any issues arising from third-party integrations should be directed to the respective provider.

When you publish an application through Flexbuild, it is deployed to a public URL. You are solely responsible for the content and functionality of applications you publish.

Published applications must comply with all applicable laws and these Terms. We reserve the right to remove any published application that violates these Terms, contains harmful content, or is reported for abuse.

We do not guarantee the perpetual availability of published applications. We may discontinue hosting at our discretion with reasonable notice.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that: (a) the Service will be uninterrupted, secure, or error-free; (b) AI-generated code will be free of bugs, vulnerabilities, or defects; (c) the results obtained from the Service will be accurate or reliable; or (d) any defects in the Service will be corrected.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FLEXBUILD AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (a) YOUR USE OR INABILITY TO USE THE SERVICE; (b) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS OR YOUR DATA; (c) ERRORS OR OMISSIONS IN AI-GENERATED CODE; OR (d) ANY OTHER MATTER RELATED TO THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (a) THE AMOUNT YOU PAID TO FLEXBUILD IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (b) ONE HUNDRED US DOLLARS ($100).

You agree to indemnify, defend, and hold harmless Flexbuild and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) applications you create, publish, or distribute using the Service.

You may terminate your account at any time by contacting us or through your Account Settings. Upon termination, your right to use the Service ceases immediately.

We may suspend or terminate your account at any time for any reason, including violation of these Terms, with or without notice. Upon termination, we may delete your account data in accordance with our Privacy Policy.

Sections that by their nature should survive termination will survive, including Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law.

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict-of-law principles.

Any dispute arising from or relating to these Terms or the Service shall first be resolved through good-faith negotiation. If the dispute cannot be resolved within 30 days, it shall be submitted to binding arbitration under the rules of the American Arbitration Association. The arbitration shall take place in Wilmington, Delaware.

Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Flexbuild regarding the Service and supersede all prior agreements.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
